These Terms and Conditions apply to purchases made through the Blakmint online store.

Please read them before placing an order. By ordering from our website, you agree to these Terms together with our:

  • Shipping and Delivery Policy

  • Returns and Refund Policy

  • Privacy Policy

  • Cookie Policy

  • Product Instructions for Use

Nothing in these Terms excludes or restricts your statutory rights under UK consumer law.

In these Terms, “Blakmint”, “we”, “us” and “our” mean Blakmint Ltd.

“You” and “your” mean the person placing an order through our website.

2. Who can place an order

You must be at least 18 years old and legally capable of entering into a binding contract.

Our products are primarily offered to consumers purchasing for personal use.

Please contact us before purchasing products for commercial resale, professional distribution or export.

We currently accept orders for delivery within the United Kingdom only.

3. Our products

Blakmint sells products intended for the cleaning, storage, handling and maintenance of removable oral appliances, including:

  • liquid retainer cleaner;

  • retainer and aligner cleaning brushes;

  • cleaning and storage cases;

  • retainer removal tools;

  • aligner chewies; and

  • kits and bundles containing these products.

Certain Blakmint products are registered as Class I medical devices in the United Kingdom.

Products must be used only for their stated intended purpose and in accordance with:

  • the product label;

  • packaging information;

  • warnings;

  • the Instructions for Use;

  • any directions provided by a dentist or orthodontist; and

  • any instructions supplied by the oral-appliance manufacturer.

Our products do not replace professional dental advice, diagnosis, treatment, appliance fitting or inspection.

4. Product information and images

We take reasonable care to ensure that product descriptions, photographs, measurements, specifications and prices are accurate.

However:

  • colours may vary slightly according to screen settings;

  • product packaging may be updated;

  • photographs may not show products at their exact scale;

  • minor differences may occur between manufacturing batches; and

  • non-material design or packaging changes may be made without notice.

Any material change affecting the product’s intended use, performance or safety will be reflected in the relevant product information or Instructions for Use.

5. Product compatibility

Removable oral appliances differ in material, design, construction, age and condition.

A product’s suitability may depend on:

  • the appliance material;

  • its manufacturer’s instructions;

  • its age and condition;

  • previous damage;

  • exposure to heat;

  • normal wear;

  • grinding or clenching;

  • the cleaning method used; and

  • the advice of the customer’s dentist or orthodontist.

You must check that the Blakmint product and cleaning method are suitable for your oral appliance.

Where compatibility is uncertain, contact your dentist, orthodontist or appliance manufacturer before use.

6. Inspecting the oral appliance

You must inspect your appliance before and after cleaning.

Do not use a Blakmint cleaning product on an appliance showing structural damage or significant deterioration, including:

  • cracks, splits or holes;

  • significant warping or distortion;

  • brittle or crumbling material;

  • unusual softening;

  • thinning or weakened areas;

  • rough, broken or sharp edges; or

  • visible material breakdown.

Cloudiness, staining, whitening or discolouration alone may not mean that an appliance is structurally damaged.

However, where those changes occur together with cracking, brittleness, thinning, distortion, softening or other material deterioration, stop use and seek advice from your dentist, orthodontist or appliance provider.

Do not continue cleaning or wearing an appliance that a dental professional has advised should be repaired or replaced.

7. Appliance age and normal wear

Removable oral appliances naturally wear and deteriorate over time.

Their useful life varies according to factors including:

  • material;

  • design and construction;

  • frequency of use;

  • oral habits;

  • grinding or clenching;

  • storage;

  • heat exposure;

  • cleaning methods; and

  • the appliance provider’s recommendations.

Older, heavily used, previously damaged or poorly maintained appliances may be more vulnerable to scratching, cracking, warping or other deterioration during ordinary handling or cleaning.

Normal wear, deterioration or a pre-existing appliance defect does not by itself establish that a Blakmint product was faulty.

8. Following the Instructions for Use

You are responsible for reading and following the Instructions for Use supplied with each product.

This includes responsibility for:

  • preparing the correct dilution;

  • accurately measuring the product;

  • using lukewarm water;

  • observing the recommended soaking time;

  • brushing gently;

  • avoiding abrasive materials;

  • fully rinsing the appliance;

  • cleaning and drying reusable containers;

  • replacing prepared solution as directed;

  • inspecting the appliance before and after use;

  • confirming ultrasonic compatibility; and

  • following professional and appliance-manufacturer advice.

The Instructions for Use form part of the product information and should be retained for future reference.

Medical-device instructions are intended to inform users about safe and proper use, intended performance and necessary precautions. (GOV.UK)

9. Use of the liquid cleaner

Blakmint Liquid Retainer Cleaner must be prepared at the dilution stated in its Instructions for Use.

You must not:

  • use the concentrated product undiluted;

  • exceed the recommended concentration;

  • estimate measurements without using a suitable measure;

  • use hot or boiling water;

  • heat the prepared cleaning solution;

  • microwave the product or solution;

  • mix it with cleaning tablets;

  • mix it with bleach, mouthwash, household cleaners or other chemical products;

  • use it as mouthwash;

  • swallow it; or

  • place the concentrated cleaner directly into the mouth.

The oral appliance must be thoroughly rinsed with clean water before being placed back in the mouth.

10. Soaking times

Routine cleaning should be performed for the period stated in the Instructions for Use.

Where occasional overnight soaking is permitted, it must be carried out only:

  • at the correct dilution;

  • with lukewarm water;

  • in a suitable closed container;

  • on an appliance compatible with extended soaking;

  • where the appliance manufacturer or dental professional has not advised against it; and

  • for no longer than one overnight period.

An appliance must not be left soaking beyond the permitted period.

If softening, warping, cracking, unusual dulling or another material change is noticed, discontinue use and seek professional advice.

11. Brushing and over-scrubbing

Where brushing is recommended, use a suitable soft brush with light pressure.

You must not:

  • scrub forcefully;

  • use rapid or repeated heavy scrubbing;

  • repeatedly scrape one area;

  • bend or twist the appliance while brushing;

  • use abrasive toothpaste;

  • use abrasive cleaning powders;

  • use a hard-bristled brush;

  • use metal tools, sharp implements or scourers; or

  • continue brushing if the appliance starts to flex, scratch, split or change shape.

Excessive force or abrasive brushing may scratch, weaken or damage an oral appliance.

Damage caused solely by over-scrubbing, unreasonable force, abrasive materials or failure to follow the brushing instructions does not establish that the Blakmint brush or cleaner was defective.

This does not affect your rights where a Blakmint product was itself faulty, unsafe or not as described.

12. Reusing prepared solution

Prepared Blakmint cleaning solution may be reused only for the period and under the conditions stated in the Instructions for Use.

You must:

  • keep reusable solution in a clean, suitable container;

  • secure the lid properly;

  • replace it within the stated period;

  • replace it sooner if visibly contaminated;

  • clean and dry the container as directed; and

  • avoid continually topping up old solution.

Do not reuse a prepared solution beyond Day 6.

Blakmint is not responsible for contamination or loss caused solely by keeping or reusing prepared solution contrary to the Instructions for Use.

13. Ultrasonic cleaning devices

Blakmint Liquid Retainer Cleaner may be used only in a compatible ultrasonic cleaning device operating on a non-heated cleaning cycle.

The user is responsible for ensuring that the ultrasonic cleaner:

  • is lawfully placed on the UK market;

  • is suitable for removable oral appliances;

  • is in safe working condition;

  • is used according to its manufacturer’s instructions;

  • permits the use of diluted liquid cleaning solution;

  • is operated without heating the liquid; and

  • is not damaged, modified or counterfeit.

You must not use Blakmint with:

  • a heated ultrasonic cycle;

  • a machine whose heating function is activated;

  • hot or boiling water;

  • a machine that causes the solution to become hot;

  • a machine whose heating function cannot be disabled;

  • an ultrasonic cleaner not intended for oral appliances;

  • an unlawfully supplied or non-compliant device;

  • a damaged or modified machine;

  • excessive or repeated ultrasonic cycles; or

  • any device used contrary to its manufacturer’s instructions.

Blakmint has not been approved for use with heated ultrasonic cleaning cycles.

Heat may soften, distort or damage thermoplastic retainers, aligners and similar appliances.

If the liquid becomes hot during use, stop the machine immediately and remove the appliance.

Medical devices should be used as described by their manufacturer. Use outside the manufacturer’s instructions may constitute off-label use and can increase the user’s responsibility for resulting harm. (GOV.UK)

14. Third-party ultrasonic devices

Blakmint does not manufacture, supply, inspect or control every third-party ultrasonic cleaner available to consumers.

The appearance of an ultrasonic cleaner in marketing content does not amount to approval of every machine, model, seller, temperature setting or cleaning cycle.

Blakmint does not warrant that its cleaner is compatible with:

  • every ultrasonic device;

  • every oral-appliance material;

  • heated ultrasonic devices;

  • devices purchased from unauthorised sellers;

  • counterfeit devices;

  • modified devices; or

  • machines that do not comply with applicable UK requirements.

Damage caused solely by heat, a defective third-party machine, an incompatible device, unauthorised modification or use contrary to the third-party manufacturer’s instructions does not establish that Blakmint Liquid Retainer Cleaner was defective.

Nothing in this section excludes liability where the Blakmint product itself was defective, unsafe or supplied with inadequate instructions.

15. Customer misuse

Misuse may include:

  • failing to follow the Instructions for Use;

  • using the wrong dilution;

  • using the cleaner undiluted;

  • using hot or boiling water;

  • heating the product or prepared solution;

  • soaking beyond the permitted time;

  • forceful or abrasive scrubbing;

  • using abrasive toothpaste or cleaning products;

  • bending, twisting or dropping the appliance;

  • combining Blakmint with another chemical product;

  • failing to rinse the appliance;

  • using the product on a visibly damaged appliance;

  • using a heated or unsuitable ultrasonic device;

  • failing to switch off an ultrasonic heating function;

  • using repeated or excessive ultrasonic cycles;

  • storing reusable solution in an ultrasonic tank;

  • reusing contaminated solution;

  • continuing use after an adverse change becomes apparent; or

  • using the product for a purpose other than its intended use.

Damage resulting solely from misuse does not mean that the Blakmint product was faulty.

16. Investigating reported appliance damage

Where a customer reports damage to an oral appliance, we may reasonably ask for information necessary to investigate the report.

This may include:

  • photographs or videos of the appliance;

  • photographs taken before and after cleaning, where available;

  • the appliance type and material;

  • its approximate age;

  • details of existing wear or damage;

  • the cleaner dilution used;

  • soaking duration;

  • water temperature;

  • brushing method;

  • brush type;

  • whether an ultrasonic cleaner was used;

  • the ultrasonic machine’s brand and model;

  • whether it included a heating function;

  • the number and duration of ultrasonic cycles;

  • batch or lot details from the Blakmint product; and

  • whether the Instructions for Use were followed.

Customers should retain the relevant Blakmint product, packaging and appliance while a complaint is investigated.

Requesting information does not remove or delay any legal remedy to which the customer is entitled.

17. Product safety incidents

Stop using a product immediately if you believe it may be unsafe or associated with an adverse incident.

Contact us at admin@blakmint.co.uk and provide, where possible:

  • your order number;

  • the product name;

  • the batch or lot number;

  • a description of the incident;

  • photographs or video;

  • details of how the product was used; and

  • details of any medical or dental advice received.

Seek urgent medical or dental assistance where required.

As a medical-device manufacturer, Blakmint may need to record, investigate and report safety information in accordance with applicable post-market surveillance requirements. UK medical-device manufacturers must comply with the relevant regulatory requirements, and strengthened post-market surveillance rules have applied since June 2025. (GOV.UK)

18. Availability

All products are subject to availability.

Placing an item in your basket does not reserve it.

If a product becomes unavailable after an order is placed, we may:

  • offer an alternative with your agreement;

  • provide a revised estimated dispatch date; or

  • cancel the affected item and issue a refund.

We will not substitute a materially different product without your agreement.

19. How the contract is formed

Products displayed on the website constitute an invitation to place an order.

When you place an order, you make an offer to purchase the products shown in your order summary.

You will normally receive an order-confirmation email acknowledging receipt.

Unless we state otherwise, a binding sales contract is formed when we send a dispatch-confirmation email.

We may decline or cancel an order before dispatch where:

  • the product is unavailable;

  • payment cannot be authorised;

  • an obvious pricing or description error occurred;

  • the delivery address is outside the area we serve;

  • fraud or unauthorised payment is suspected;

  • purchase restrictions have been exceeded; or

  • we are legally unable to supply the product.

Where payment has already been taken, the affected amount will be refunded.

20. Order information

You are responsible for checking that the information provided during checkout is correct, including:

  • your name;

  • email address;

  • delivery address;

  • billing details;

  • selected products; and

  • quantities.

Contact us immediately if you notice an error.

We cannot guarantee that an order can be changed after processing or dispatch has begun.

21. Prices and VAT

All prices are shown in pounds sterling.

Prices include VAT where VAT is applicable.

Delivery charges are shown separately at checkout before the order is submitted.

We may change prices at any time, but a later price change will not affect a contract already formed.

22. Pricing and technical errors

We take reasonable care to ensure that product information and prices are correct.

Where an obvious and unmistakeable pricing, discount or technical error has occurred, we may contact you before dispatch and ask whether you wish to proceed at the correct price.

We may cancel and refund an order where:

  • the displayed price was clearly incorrect;

  • the discount resulted from an obvious technical fault;

  • the product information contained a material error; or

  • it would be unreasonable to expect us to honour an obvious mistake.

This does not permit us to change an agreed price merely because the sale later becomes commercially disadvantageous.

23. Payment

Payment must be authorised before dispatch.

Payments are processed through Shopify and the third-party payment providers available at checkout.

We do not normally store complete card information.

The payment methods available may vary according to your device, location, card provider and Shopify checkout settings.

24. Promotions and discount codes

Promotional offers are subject to any conditions displayed with them.

Unless stated otherwise:

  • only one discount code may be used per order;

  • discount codes cannot be exchanged for cash;

  • codes may apply only to selected products;

  • codes may expire;

  • codes cannot normally be added after an order is submitted; and

  • an offer affected by an obvious error may be corrected or withdrawn.

Discounted and sale products retain the same statutory consumer protections as full-price goods.

25. Delivery

We deliver within the United Kingdom only.

Most orders are sent using Royal Mail Tracked 48.

A retainer brush purchased on its own is normally sent using Royal Mail 2nd Class.

Where a brush is ordered with another product, the order will normally be sent using Royal Mail Tracked 48.

Delivery times are estimates rather than guarantees unless a guaranteed delivery service is expressly offered.

Unless a different period is agreed, goods must be delivered without undue delay and generally within 30 days after the contract is formed. (GOV.UK)

26. Delivery risk

Goods remain at our risk until they come into your physical possession or the physical possession of a person you nominated to receive them.

If a parcel is missing, you should contact Blakmint. We will investigate the delivery with Royal Mail where necessary.

27. Cancellation rights

For most products bought online, customers have 14 days after delivery to notify the retailer that they wish to cancel, followed by a further 14 days to return eligible goods. (GOV.UK)

28. Hygiene-sealed products

Certain Blakmint products are supplied sealed for health-protection and hygiene reasons.

These may include:

  • retainer brushes;

  • removal hooks;

  • aligner chewies;

  • mouth-contact accessories;

  • cleaning cases intended for oral appliances;

  • liquid cleaner with a tamper-evident seal; and

  • other products clearly identified as hygiene-sensitive.

The normal change-of-mind cancellation right does not apply where:

  • the goods were supplied sealed;

  • they are unsuitable for return for health-protection or hygiene reasons; and

  • they were unsealed after delivery.

The Consumer Contracts Regulations expressly recognise this exception for qualifying sealed hygiene goods. (Legislation.gov.uk)

This does not remove the customer’s rights where an item is faulty, unsafe, damaged, incorrectly supplied or not as described.

29. Faulty goods and statutory rights

Goods supplied by Blakmint must be:

  • of satisfactory quality;

  • fit for their stated purpose; and

  • as described.

These requirements form part of consumer contracts under the Consumer Rights Act 2015. (Legislation.gov.uk)

Where goods fail to conform to the contract, customers may be entitled to remedies including:

  • rejection and refund;

  • repair;

  • replacement;

  • price reduction; or

  • final rejection.

The short-term right to reject faulty goods generally lasts at least 30 days. (Legislation.gov.uk)

Opening a sealed product where reasonably necessary to discover a fault does not automatically remove statutory rights.

30. Returns and refunds

Eligible change-of-mind returns must comply with our Returns and Refund Policy.

For a full eligible cancellation, we will refund:

  • the price paid for the returned goods; and

  • the cost of our least expensive standard outbound delivery method, where required by law.

Customers are normally responsible for the direct cost of change-of-mind returns.

We will cover reasonable return costs where goods are faulty, damaged, incorrect or not as described.

We may withhold a change-of-mind refund until we receive the returned goods or evidence that they were sent back.

31. Our responsibility to consumers

We are responsible for loss or damage that is a foreseeable result of:

  • our breach of these Terms; or

  • our failure to exercise reasonable care and skill.

Loss is foreseeable where it was obvious that it might occur or where both parties knew that it might occur when the contract was formed.

Nothing in these Terms excludes or restricts liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation;

  • a defective product where liability cannot lawfully be excluded;

  • breach of statutory consumer rights; or

  • any other liability that cannot lawfully be limited.

Medical devices placed on the UK market must meet the applicable requirements and be acceptably safe and suitable for their intended purpose. (GOV.UK)

32. Loss or damage for which we are not responsible

Subject to section 31, we are not responsible for loss or appliance damage caused solely by:

  • failure to follow the Instructions for Use;

  • incorrect dilution;

  • undiluted product use;

  • excessive soaking;

  • use of hot or boiling water;

  • heating the cleaning solution;

  • aggressive or abrasive brushing;

  • use of abrasive toothpaste or materials;

  • bending, twisting or dropping an appliance;

  • normal appliance wear or deterioration;

  • a pre-existing appliance defect;

  • continued use of a visibly damaged appliance;

  • use with an incompatible chemical or cleaning product;

  • use of an unsuitable ultrasonic machine;

  • use of a heated ultrasonic cycle;

  • use of an unlawfully supplied, counterfeit, modified or damaged third-party device;

  • failure to follow the ultrasonic manufacturer’s instructions;

  • repeated or excessive ultrasonic cycles;

  • incorrect storage or reuse of prepared solution; or

  • another use outside the stated intended purpose.

This section does not apply where the loss was caused by a defective Blakmint product, inadequate Blakmint instructions, our negligence or another matter for which liability cannot lawfully be excluded.

33. Business losses

Our consumer products are supplied for private and domestic use.

Where you use a product for a commercial or business purpose without our prior written agreement, we are not responsible for:

  • loss of profit;

  • loss of revenue;

  • loss of business;

  • business interruption; or

  • loss of commercial opportunity,

except where liability cannot legally be excluded.

This does not affect rights held by a consumer purchasing wholly or mainly for personal use.

34. Events outside our control

We are not responsible for delay or failure caused by circumstances outside our reasonable control, including:

  • severe weather;

  • fire or flood;

  • postal disruption;

  • industrial action;

  • transport interruption;

  • supply-chain disruption;

  • government action;

  • interruption to communications or utilities; or

  • another event we could not reasonably prevent.

We will take reasonable steps to minimise the effects and notify affected customers where appropriate.

This does not remove any cancellation or refund rights that apply.

35. Website availability

We aim to keep the website available and secure, but we cannot guarantee uninterrupted access.

The website may be temporarily suspended or restricted for:

  • maintenance;

  • technical updates;

  • security;

  • fraud prevention; or

  • circumstances outside our control.

This will not affect sales contracts already formed.

36. Intellectual property

Unless otherwise stated, all intellectual property in the website and its content is owned by or licensed to Blakmint Ltd.

This includes:

  • the Blakmint name and logo;

  • product names;

  • product and packaging designs;

  • photographs;

  • graphics;

  • text;

  • video;

  • downloadable materials; and

  • website code.

Website content may be used only for personal, non-commercial shopping purposes.

You must not reproduce, modify, distribute, publish, sell or commercially exploit protected content without written permission.

37. Reviews and customer content

Where customers can submit reviews, images or videos, submitted content must not be:

  • false or misleading;

  • defamatory;

  • abusive;

  • unlawful;

  • discriminatory;

  • obscene;

  • infringing of intellectual-property rights;

  • infringing of another person’s privacy;

  • promotional spam; or

  • infected with malicious code.

You must have permission to upload content containing another person.

We may moderate or remove content that breaches these conditions.

You retain ownership of your content but grant Blakmint a non-exclusive, royalty-free licence to display and use it in connection with the website, products and marketing, subject to applicable privacy law and any separate permissions obtained.

38. Acceptable website use

You must not:

  • use the website unlawfully;

  • place fraudulent orders;

  • provide false payment or delivery details;

  • attempt unauthorised access;

  • interfere with security;

  • introduce malware;

  • impersonate another person;

  • scrape or overload the website in a disruptive manner; or

  • infringe our or another person’s rights.

We may restrict access or cancel suspected fraudulent orders where reasonably necessary.

39. Personal information

We process personal information in accordance with our Privacy Policy and Cookie Policy.

Information may be processed for purposes including:

  • order fulfilment;

  • payment processing;

  • Royal Mail delivery;

  • customer service;

  • fraud prevention;

  • regulatory compliance;

  • product-safety monitoring;

  • product recalls; and

  • consent-based marketing.

Payment details are handled by secure payment providers and are not normally stored directly by Blakmint.

40. Complaints

Complaints should be sent to:

Please include:

  • your name;

  • order number;

  • a description of the issue; and

  • relevant photographs or evidence.

We will attempt to resolve complaints fairly and directly.

Where a dispute cannot be resolved, the parties may consider an appropriate accredited alternative dispute-resolution provider. We are not agreeing in advance to use a particular ADR provider unless we expressly confirm this or are legally required to do so.

41. Governing law and courts

These Terms are governed by the laws of England and Wales.

Consumers living in England or Wales may generally bring proceedings in the courts of England and Wales.

Consumers living in Scotland may generally bring proceedings in the Scottish courts.

Consumers living in Northern Ireland may generally bring proceedings in the Northern Irish courts.

Nothing in this section removes mandatory consumer protections available where you live.

42. Changes to these Terms

We may update these Terms to reflect changes in:

  • law or regulation;

  • products;

  • safety information;

  • delivery services;

  • payment systems;

  • website functionality; or

  • business operations.

The version in force when the sales contract was formed will normally apply to that order.

A later update will not retrospectively remove rights applying to an existing order.

43. Severability

If a court or competent authority finds any provision unlawful or unenforceable, the remaining provisions will continue to apply.

44. Delay in enforcing rights

If either party delays enforcing a right, this does not mean that the right has been waived.

45. Transferring the contract

We may transfer our rights or obligations to another organisation provided that doing so does not reduce your consumer rights.

You may transfer your rights where the law permits. We may request reasonable evidence of the transfer.

46. Third-party rights

The contract is between you and Blakmint Ltd.

No other person has a right to enforce these Terms except where applicable law provides otherwise.
